Probate/Estate Real Estate Glossary:

Administrator.....Court appointed person or entity to administer estate when no will exists.

Beneficiary.....A person who inherits when there is a will.

Decedent.....he person who died.

Executor.....Individual or company appointed, by will, to execute the will.

Independent Administrator's Act.....An act (effective July 1, 1986) which allows property in an estate to be sold without court confirmation.

Inheritance Tax Referee......A person who evaluates the assets (probate inventory) of the deceased.

Intestate;.....Term used when a person dies without a will.

Intestate Succession.....The order of who inherits the property when the decedent does not have a will.

Letters Testimentary.....Court order given to the Executor or Administrator to proceed with the probate estate.

Probate.....(Noun) Assets of a deceased person.

                     (Verb) To execute the distribution of assets of a deceased person by will or by law.´

Public Administrator.....Person or entity appointed by the State to adct when there is no will nor relatives.

Testate.....Designation that the decedent died leaving a will.

Trust.....A legal title to property held by one party for the benefit of another.

Vacating Sale......The action taken when the buyer in a court confirmed sale does not complete the transaction.

Will.......Instrument left by the deceased stating his/her wishes for the disbursement of assets.
